Terms and conditions for using our photography and artwork services

By accessing and using the services provided by Nicoleen's Lens & Brush, you accept and agree to be bound by the terms and conditions as well as provision of this agreement. If you do not agree to abide by the above, please do not use this service.
This policy forms part of our overall service agreement, together with our Terms & Conditions, Privacy Policy, Booking Policy, and Shipping & Returns Policy.
By accessing and using the services provided by Nicoleen's Lens & Brush, you accept and agree to be bound by the terms and conditions as well as provision of this agreement. If you do not agree to abide by the above, please do not use this service.
You must be at least 18 years old to use our website. By using the site, you confirm that you are at least 18 years old or have obtained permission from a parent or guardian.
Nicoleen's Lens & Brush provides:
Some features of the website may require account registration. You agree to provide accurate and complete information during the registration and booking process ensuring it is up to date information and should inform by sending an email to Nicoleen's Lens & Brush should anything change during the time services are provided.
You may be given the opportunity to submit content, such as photos or comments, to our Web Site. By submitting content, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such content.
All content, trademarks, logos and intellectual property on our website are owned or licensed by us. You may not use, reproduce, distribute or create derivative works from our intellectual property without our prior written permission.
Nicoleen's Lens & Brush retains copyright to all photographs. Clients receive usage rights for personal use. Commercial use requires separate licensing agreement.
Upon full payment, clients receive full ownership of commissioned artwork. Nicoleen's Lens & Brush retains the right to photograph artwork for portfolio purposes.
The agreement is concluded when the customer confirms and books a shoot. Changes to the agreement or deviations from these general terms and conditions can only be agreed in writing.
We grant you a limited, non-exclusive, non-transferable and revocable license to access and use our website for personal, non-commercial purposes.
Prices for our services are listed on the website and are subject to change without notice. We are not responsible for errors in pricing or other information on the website.
Nicoleen's Lens and Brush reserves the right to increase agreed prices. This can only be justified in advance for payments that are not yet due. The increase must be the result of a change in circumstances occurring after the conclusion of the agreement. This change must be of such a nature that Nicoleen's Lens and Brush cannot reasonably be expected to be bound by the agreed prices.
Payment for services is accepted via bank transfer, Tikkie or cash.
Cancellation of the photo shoot must be made in writing at least 24 hours in advance, otherwise the full cost of the shoot will be charged. If a deposit has been paid and cancellation occurs within 24 hours of the shoot, the deposit will be forfeited.
Our Privacy Policy describes how we collect, use and protect your personal information. By using our website, you consent to the practices described in the Privacy Policy.
We reserve the right to terminate or suspend your account and access to the website without notice if you violate these Terms and Conditions.
Nicoleen's Lens & Brush shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.
These general terms and conditions govern all quotations and agreements between the contractor and the customer. By booking a shoot, the customer acknowledges and accepts these terms. Once payment is made, the applicability of these terms is binding and cannot be waived.
If the customer attempts to apply their own general terms and conditions or rejects specific clauses in the contractor's terms upon confirming the order, the contractor's general terms and conditions will still apply in full.
In case of any conflict between the provisions of these general terms and conditions and those outlined in a specific agreement, the terms of the agreement will take precedence.
We shall not be held responsible for any failure or delay in performance under this agreement which is due to earthquake, fire, flood, epidemic, acts of God, war, terrorism, or other causes beyond our reasonable control.
These terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
We reserve the right to update or modify these Terms and Conditions at any time without notice. Your continued use of the website following such changes constitutes your acceptance of the updated Terms and Conditions.
